WENTZELEE BOTHA, ESQ.

Ms. Botha is a Partner at Brown & Winters. She focuses her practice mainly on environmental insurance coverage, insurance archaeology, bad faith litigation, and environmental litigation and regulatory administrative proceedings. She specializes in insurance archaeology and in the procurement of historic insurance proceeds for coverage of legal or regulatory claims arising out of pollution by current or historic toxic waste releases. Her clients are mainly public entities and include the Port of Los Angeles, City of San Pablo, and others. For the Port of Los Angeles, her insurance archaeology and coverage positions procured extensive new primary insurance proceeds for the Port of Los Angeles' environmental pollution.

Ms. Botha also assists the Port with environmental cost recovery litigation under state and federal CERCLA laws pertaining to various contaminated boat and shipyards. She participated in the cleanup of the San Diego Bay sediment on behalf of the San Diego Unified Port District under various San Diego Regional Water Quality Control Board Cleanup and Abatement Orders and other regulatory actions. Ms. Botha also has experience with other environmental components including landfills, soil and groundwater, MS4s, and assists in advising clients regarding Assembly Bill No. 440 (AB 440), the successor policy to the Polanco Redevelopment Act involving Brownfields. She focuses on project management involving expert interfacing regarding environmental forensics, sediment transportation and deposition, 3D modeling, toxicology, and bioremediation. Ms. Botha further participates in protecting the interests of the firm's public entity clients under the Clean Water Act's Total Maximum Daily Load (TMDL) programs and the California State Water Resources Control Board's Sediment Quality Objective programs (SQOs).

Ms. Botha is admitted to practice in California and before the United States Patent and Trademark Office, United States Court of Appeals, Federal Circuit, United States Court of Appeals, Ninth Circuit, and Southern and Central District Courts of California.

She is a 1999 graduate of California Western School of Law and obtained a B.S. undergraduate and B.S. Honors post graduate degree from the University of Port Elizabeth, South Africa, in Biochemistry and Marine Biology.
